Developer Sues Fairfield Board

FAIRFIELD - A Fairfield developer trying to build a $45 million mixed-use development by the Southport Railroad Station is challenging a town zoning board's denial of the project last month. Stuart Baldwin, managing member of Southport Village Partners, filed a lawsuit against the Town Plan & Zoning (TPZ) Commission over its January 22 rejection of the proposed development. Baldwin on February 8 also filed a complaint with the town's Ethics Commission against TPZ member Theodore Cook Jr. Baldwin said Cook should not have voted on the plans because he is a shareholder in an adjacent business. We feel it was the wrong decision and wrongfully influenced [by Cook], Baldwin said in a published report.
In the suit, Austin Wolf, attorney for Southport Village Partners, said the TPZ did not have discretion to reject the proposed development because the plans meet standards in town zoning regulations. Wolf also contends that Cook's involvement in the Southport Racquet Club and Cook's aggressive opposition to the development invalidates the TPZ's decision.
The Southport Racquet Club is adjacent to 4.74 acres where Baldwin wants to build 26 luxury condominiums, some 29,000 square feet of office space and a 32,000-square-foot building to house a 19-room inn, restaurant and 11 smaller condominiums. In the Ethics Commission complaint, Baldwin argues that the racquet club has general interests potentially adverse to SVP since their large membership has extensive parking needs.
