Franchisee Sues Dunkin' Donuts

SEYMOUR - An Oxford Dunkin' Donuts franchisee is suing the parent company for allegedly excluded her from an opportunity to open an in-store franchise in the Seymour Super Stop & Shop because of her gender.
The lawsuit filed by Anna Tessitore of Simian Inc. late last month in Milford Superior Court seeks unspecified damages from the Randolph Mass.-based Dunkin' Donuts. Also named in the complain are Dunkin' Donuts franchisee Manuel Rocha and the two Naugatuck franchises he owns.
Tessitore claims the company awarded Rocha the Stop & Shop franchise despite company policy giving the first shot at new branches to the nearest franchisee in good standing. Tessitore's Oxford Road franchise is a mile from the supermarket; Rocha's nearest Dunkin' Donuts is nine miles away, she said.
"Dunkin' Donuts has violated its expansion policies and improperly excluded [Tessitore] from the opportunity to operate the Dunkin' Donuts donut shop in the Seymour Stop & Shop," she alleges in the suit. The suit claims gender discrimination and violation of the Connecticut Unfair Trade Practices Act.
