HARTFORD - The Cross-Sound Cable Co. has filed suit in state court to operate its power line to Long Island, even though it is not buried deep enough under New Haven Harbor. Attorney General Richard Blumenthal called it a meritless lawsuit that represents the third time the company has tried to bypass permit requirements. A hearing in New Haven Superior Court on the action was scheduled for February 3, as this edition was published.
Cross-Sound Cable believes the lawsuit, filed January 28, is the only way it can supply Long Island with power until it eventually submerges the $130 million cable to the proper depth along hundreds of feet of harbor seabed.
The company maintains that it should be permitted to energize the line, despite a recent ruling against it by the state Department of Environmental Protection and a moratorium on new utility work that is in effect until June.
