'Common Sense' Can Help Avoid School Litigation

NEW HAVEN - An expert in education law told faculty and staff at Southern Connecticut State University that much recent litigation against schools and universities could be avoided by taking some common-sense pro-active steps.
"Don't view your students as terrorists," said Scott D. Makar, a Florida attorney who is former editor-in-chief of the University of Florida Journal of Law & Public Policy. At a recent SCSU faculty forum entitled "Litigious Students & Academic Disputes," Makar suggested that treating students with respect, giving them due process and seeking to find reasonable solutions to problems where feasible could helped to avoid potentially expensive lawsuits. The event drew about 100 attendees.
SCSU Associate Vice President for Academic Affairs Ellen Russell Beatty, who organized the event, said she found the session an excellent tool to enlighten faculty and staff about a timely subject. "We are living today in a litigious society and it is important for any university to gain an increased understanding and awareness of the legal issues we face," Beatty said.
