FCC Seeks to Fine SBC in DSL Probe

WASHINGTON, D.C. - Regulators proposed fining local telephone giant SBC Communications Inc. (NYSE: SBC) $100,000 for hindering an investigation into possible discrimination in provisioning high-speed Internet service and maintenance.
The FCC said it asked the parent company of SNET to provide information about provisioning and maintaining digital subscriber line (DSL) service to affiliated and unaffiliated Internet service providers (ISPs). SBC in April said it had data that showed unaffiliated and affiliated ISPs were treated the same. That led the FCC to ask for a sworn statement for the information and while SBC filed the information, the company refused to do so in a sworn statement.
We consider SBC's conduct in this case to be egregious because its failure to submit a sworn written response to the [enforcement] bureau hinders the bureau's investigation into SBC's possible discrimination in provisioning and maintenance of DSL,'' the FCC said in its proposed fine.
