HAMDEN - Mayor Carl Amento announced that the town has prevailed in a legal action against New Haven Scaffolding Inc. (NHS) at 975 Dixwell Avenue. Town attorneys had gone to court to enforce zoning regulations regarding the property, which is characterized as an eyesore. The attorneys argued that NHS was in violation of a special permit it had received from the Planning & Zoning Commission by maintaining scaffolding on the property's front lawn and failing to screen the property with a landscaping buffer.
Following a number of court appearances, the Superior Court issued a preliminary injunction against NHS on June 4. However, on August 9, town lawyers were forced to return to court with a motion for contempt, arguing that NHS had failed to comply with the injunction.
Most recently, on October 9, the town and NHS entered into a stipulated judgment by which NHS must vacate the property by December 1.
Says Amento, The removal of the New Haven Scaffolding business from the premises will be a very positive development in Highwood.
