Bayer, Glaxo Accused of Predatory Pricing

NEW HAVEN - Three customers sued in state court in New Haven claiming GlaxoSmithKline PLC and Bayer AG tried to eliminate competition by lowering Baycol's price to unprofitable levels. The Westport-law firm of Ury & Moskow accuses Bayer of misrepresenting the efficacy of Baycol. The suit, which seeks class-action status and more than $2 billion in damages, claims Bayer and GlaxoSmithKline coordinated with health-care providers and pharmacies to use Baycol instead of competitors' drugs, even though the drug was less effective and more dangerous. GlaxoSmithKline and Bayer had a marketing agreement to sell Baycol in the U.S.
