STAMFORD - Pamela Fink is suing her employer of four years, MXEnergy, for allegedly terminating her over her discovery that she was pre-disposed to breast cancer. After Fink's two sisters developed breast cancer, Fink, a 39-year-old mother of two, took a genetic screening test to determine if she has a genetic pre-disposition to breast cancer. The test came back positive and Fink opted for a double mastectomy.

Fink claims that upon returning to work in her position as director of public relations for the natural gas and energy supplier, she was given reduced assignments and soon fired.

Fink's complaint to the U.S. Equal Employment Opportunity Commission and the Connecticut Commission on Human Rights and Opportunities cites the Genetic Information Nondiscrimination Act (GINA) signed into law by President Bush in May 2008. The law was established to prevent discrimination based on genetic information.

The company has said through a spokesman, "We are confident that when the facts are revealed, the company's actions will be seen in a different light and will be seen as being warranted."
