With rock-bottom prices on retail goods from breakfast cereal to beauty aids, Xpect Discounts is a favorite of many Connecticut bargain hunters in the know. However, some employers have complained that their wages were coming up a bit short, too, prompting a response from regulators.
Xpect employees in six Connecticut locations – Cromwell, Danbury, Derby, East Haven, Milford, North Haven, Danbury and Cromwell — as well as workers in corporate sibling Marc’s stores in Ohio, will receive a total of $426,504 in unpaid overtime wages as directed by a consent judgment after an investigation by the U.S. Department of Labor’s Wage & Hour Division determined the company had violated the overtime pay provisions of the Fair Labor Standards Act (FLSA).
The consent judgment was entered in federal district court for Cleveland, O. Both Xpect Discounts and Marc’s are retail business names of stores selling groceries, health and beauty items and closeout products operated by Marc Glassman Inc. in Cleveland.
The Fair Labor Standards Act requires employees to be paid the federal minimum wage of $7.25 for all hours worked and time and one-half the regular rate of pay for hours worked over 40 in a week unless the employee is exempt from overtime pay. Employers must also maintain accurate time and payroll records.
